ENTRIES: Only one entry per reservation/email address or mailed postcard allowed. Subsequent entries will be automatically disqualified. Odds of winning depend on number of entries in any particular contest. Entries must include email address. Contest begins Thursday, July 1, 2004, at 8:00 AM Pacific Daylight Time and runs until Monday, November 1, 2004, at 12:00 PM Pacific Standard Time. Winning entries will be drawn at random by The Mark Spencer Hotel staff. There will be four monthly drawings. The final drawing will occur no later than 12:00 PM, Wednesday, November 11, 2004. All winning entries are binding and final. Winners will be notified via email. All prizes will be awarded. Entries not drawn during monthly drawings will remain eligible for subsequent monthly drawings.

ELIGIBILITY: The contest is open to US citizens aged 18 years and over. Employees and family members of employees of The Mark Spencer Hotel are not eligible to enter. Agents, directors, officers and representatives of The Mark Spencer Hotel are also not eligible to enter.

PRIZES: One (1) Round Trip Ticket (approximate total retail value US $400) on Southwest Airlines will be given to each winner, travel must take place before 6/01/05. One ticket will be awarded each month during 4 (four) consecutive months (July-October 2004). Eligible contest entrants may win only once. Odds of winning depend on the number of eligible entries received by the deadline for each drawing. Prize cannot be transferred, assigned, redeemed for cash or substituted, except Sponsor reserves the right to substitute a prize of comparable value should prize become unavailable. Any taxes are solely the responsibility of winner. The Mark Spencer Hotel staff may substitute a prize of equal or greater value without advance notice to eligible entrants or winners. Prizes are not transferable, subject to substitution by winners or redeemable for cash. The Mark Spencer Hotel reserves the right to use the names and email addresses of winners for publicity purposes. The names and email addresses of winners may also be entered into subsequent contests held by The Mark Spencer Hotel. Only one prize per household per year is permitted. Email addresses of all entrants will be used to transmit The Mark Spencer Hotel newsletter “Art in Action” to entrants electronically.

CONDITIONS: Winners have 72 hours (three days) after email notification from The Mark Spencer Hotel to claim their prize. All email notifications sent to winners by The Mark Spencer Hotel will be assumed to have been received as of the date/time of sending. If the 72-hour period elapses without the prize being claimed, the winner’s claim to the prize will be forfeited and another drawing will be held to select a new winner. The Mark Spencer Hotel disclaims all responsibility for lost or incomplete email entries and electronic miscommunications. By entering, participants release and hold harmless The Mark Spencer Hotel and its agents, officers and representatives from any and all liabilities, including but not limited to death, injury, disfigurement, monetary loss or the equivalent, or any other claim or action. This contest is subject to any and all applicable laws, including but not limited to federal, state and local laws and regulations.

Any attempt to deliberately undermine the validity of contest results is a violation of civil and criminal laws. Any attempt by entrants or employees of The Mark Spencer Hotel to alter or distort contest results will be considered a violation of the contest, and The Mark Spencer Hotel reserves the right to seek damages to the fullest extent of the law.
